FiberNet Contract

This Agreement is made by the individual or authorized person of the organization ("customer") identified below and Logan Telephone Cooperative ("company"). The company and customer agree to the following conditions concerning Fiber-to-the-Premise ("FiberNet") Internet service provided by the company to the customer.

  1. Customer agrees to Logan Telephone’s Service Agreement and Acceptable Use Policy.  Customer understands that the company may change agreement terms and/or pricing and the most recent terms and conditions will be shown on the company website.
     
  2. Customer agrees to maintain FiberNet service for a 12-month period beginning on the date of installation. Should the customer discontinue FiberNet or be disconnected due to nonpayment, or any other reason, within the 12-month period, the customer will be liable for and will be billed on their next statement an early termination fee ("ETF"). The ETF will be $150 during the first 10 months of the contract and $100 during the last two months.
     
  3. Customer may move the service to a new location and receive free installation at that location by executing a new contract. If the customer is still under an existing 12-month service contract, the customer will be billed a $39.95 move fee. If customer is out of contract, no move fee will be charged.
     
  4. Customer agrees that any equipment used for the provision of Fibernet service is the property of Logan Telephone Cooperative, and customer assumes full responsibility for any damage that may occur through misuse, abuse, theft, or any other reason. Customer will exercise reasonable care to ensure the equipment is maintained in good working condition. If company equipment is damaged, customer agrees to pay the replacement cost of the equipment.
     
  5. Free installation entails FiberNet setup at one location within the customer's premise. Setup at any additional locations may incur charges for time and material used by the installing personnel. Customer may add additional Wi-fi access points at current rates for installation and service. ($99 installation for each and $9.95 per additional access point per month as of April 28, 2017)
     
  6. Based upon network availability, FiberNet is a "best efforts" service. The actual speed experienced by customers may vary and depend on several factors, including but not limited to, the destination on the Internet, traffic on the Internet, and other interferers. No minimum level of speed is guaranteed without a specific service agreement.
     
  7. The company is not responsible for any external intrusion to the customer's network equipment. The customer is responsible for providing firewall protection in an effort to help prevent intrusions. Since this service is an "Always On" connection, it is the company's recommendation that each customer has appropriate firewall and virus protection on their equipment while subscribed to FiberNet service.
     
  8. The company is not responsible for any personal computer or network malfunctions and/or damage to the customer's hardware or software. Logan Telephone recommends the use of a surge suppressor for all electronic devices at customer's premise.
     
  9. The company is providing FiberNet service on a retail basis to the customer. The customer agrees to utilize the service exclusively and not to provide access to third parties either through "sharing" or "resale." Webpage hosting and caching services are prohibited with your FiberNet connection.
     
  10. Any evidence of customer breach of this agreement may lead to disconnection of the service at the sole discretion of company. The company may disconnect the service, at its sole discretion, if the company determines that any action of the customer is detrimental to the service provided to others, is detrimental to the company's network, or if the company is notified of any legal requirement to disconnect the service.
